Attorney Campbell Wins Dismissal - Client Protected by Free Speech
Attorney Michael A. Campbell won a dismissal for a client charged with Disorderly Conduct and Resisting Law Enforcement.
Attorney Campbell's client was enjoying a peaceful day inside his home when he noticed police had stopped a motorist outside his house.
As the police were searching the motorist's vehicle, he told the motorist that she did not have to consent to the search, and that if she previously gave consent, she could withdraw it.
The officers became upset and told Attorney Campbell's client to be quiet or he would be arrested. The client continued to comment on the warrantless search of the motorist's vehicle and he was subsequently arrested and charged with Disorderly Conduct and Resisting Law Enforcement.
Unknown to the officers, Attorney Campbell's client was recording the whole interaction. Attorney Campbell successfully argued that his client's speech was protected under the First Amendment because he was commenting on the legality of police conduct.
In light of the arguments and case law provided to him by Attorney Campbell, the Prosecutor handling the case dismissed all charges.
